Compliance requirements
The bidder must confirm that none of the mandatory exclusion grounds apply, including convictions for participation in a criminal organisation, corruption, fraud, terrorism, money laundering or terrorist financing; enabling illegal employment or breaching the conditions for employing a foreign national; illegal use of child labour or human trafficking; tax, fee or social security contribution arrears; or the status of being subject to an international sanction. The bidder must also confirm that none of the optional exclusion grounds apply, such as serious or persistent breach of previous public contracts or submission of false information about qualification.
In addition, the bidder’s place of residence or establishment must not be in the Russian Federation or the Republic of Belarus. Materials, equipment and goods used during the performance of the work may not be manufactured in or originate from the Russian Federation or the Republic of Belarus, and the contracting authority may request certificates of origin. Products used to provide the service must not be prohibited for use by government authorities in any NATO member state on security grounds.
Qualification criteria and exclusion grounds
The bidder’s net turnover for each of the last three completed financial years must be at least EUR 600,000. If the financial year does not coincide with the calendar year, the same requirement applies to the last three completed financial years. At least six months must have passed since the end of the last completed financial year by the time the tender is submitted. The bidder must provide an extract from the financial statements for the last three completed financial years, or other evidence showing turnover if this is already publicly available to the contracting authority from a data register.
The bidder must have experience in providing a service similar to the subject of the contract during the 36 months preceding the start of the procurement procedure. A list of completed contracts must be submitted, including their approximate value, dates and the other contracting parties.
The tender must comply with the procurement documents. The bidder must submit the cost table, a technical description of the service, and, where necessary, a power of attorney if the signatory’s authority does not arise from the articles of association. The bidder must also confirm that it accepts the contracting authority’s standard payment term unless it joins the factoring programme.
