Compliance requirements
The bidder must confirm the mandatory exclusion grounds in the tender documents, including convictions for participation in a criminal organisation, corruption and fraud. If an exclusion ground exists, the bidder may have to provide evidence of self-cleaning, and in some cases the contracting authority may accept rehabilitation measures. The machine-readable notice does not include the full list of exclusion grounds, so the official tender documents must be checked.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register of its country of establishment, or provide a copy of the founding agreement or an equivalent document if registration is not required. For an Estonian legal entity, the contracting authority checks the data in the commercial register. For all 17 lots, the bidder must hold a State Agency of Medicines licence allowing wholesale distribution of medicines in Estonia; the contracting authority checks this in the register. The bid must include the declaration on form I of Annex 3 and, where necessary, a power of attorney for representation. The bid validity period must be at least 3 months. If the bid is submitted for several lots, the declaration must list all relevant lots. The bid price and the price offer form in Annex 1 must follow the prescribed structure and include all delivery costs to the pharmacy of SA Pärnu Haigla. The machine-readable notice did not include any other precise qualification or compliance requirements; these must be checked in the tender documents.
