Compliance requirements
The notice includes standard exclusion grounds, especially convictions for participation in a criminal organisation and corruption. The bidder or its managers/representatives must confirm whether any such final conviction exists within the last five years or whether an exclusion period still applies. If an exclusion ground exists, the bidder may be able to submit evidence of self-cleaning, if allowed by the tender documents or the law.
Qualification criteria and exclusion grounds
The machine-readable notice did not include precise qualification or suitability criteria; these must be checked in the tender documents. However, when submitting a bid, the bidder must provide the technical description of the offered vehicle and the official technical documents, together with an Estonian translation, so that the contracting authority can verify compliance. The bidder must also confirm that the bid meets the characteristics of an operating lease under Accounting Standards Board Guideline No. 9: ownership does not transfer automatically at the end of the contract, any purchase option is separate and on market terms, the economic life of the leased asset is at least 84 months, the present value of lease payments at contract commencement is up to 89% lower than the vehicle’s fair value, the bidder bears the residual value and disposal risk, and the contracting authority does not make major improvements. If the bid is submitted as a joint bid, a power of attorney for the joint bidders must be included. The bidder must also confirm that the bid complies with the tender documents and that the offered goods are not subject to international sanctions and do not originate from a sanctioned area.
