Compliance requirements

The contracting authority will exclude a bidder or applicant if any of the exclusion grounds in § 95(1) points 1–5 of the Public Procurement Act apply. In practice, this means convictions for organised crime, corruption, fraud, terrorist offences, money laundering or terrorist financing; offences related to illegal employment of foreigners or paying less than the statutory wage; offences related to illegal use of child labour or human trafficking; tax, fee or environmental charge arrears, or social security contribution debts in the bidder’s home country; or a situation where the contract would breach an international sanction or a sanction of the Government of the Republic of Estonia. The bidder must confirm that none of these grounds apply.

Qualification criteria and exclusion grounds

The bidder and/or its subcontractor must have completed, within the 36 months before the start of the procurement, at least one maintenance or repair contract for underground structures of similar scope and complexity. The total value of that contract must be at least EUR 50,000. The bidder must submit the contract list form with details of the relevant contracts, including value, dates and the other contracting parties. The machine-readable notice did not include any more precise qualification or compliance requirements; the rest must be checked in the tender documents.
