The bidder must confirm the mandatory exclusion grounds in the tender documents, including convictions for participation in a criminal organisation, corruption, fraud and other listed offences. The bidder must be registered in the commercial register of its country of establishment. For an Estonian bidder, the contracting authority checks this itself; a foreign bidder must provide proof of registration if requested. For medicinal products without a marketing authorisation, the licence must be in place no later than the date the contract enters into force, and the contracting authority may request evidence of this. The bidder must submit the completed detailed price offer form in Annex 1 for all lots for which it submits a bid, and the bid price must be entered in the format required in the procurement system. Conditional bids are not allowed. Upon request by the contracting authority, the bidder must provide the summary of product characteristics (SPC) or the package leaflet for the offered medicinal product, issued by the manufacturer in Estonian or English. The bidder must confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned territories. The bidder must also confirm that it does not involve subcontractors or suppliers representing more than 10% of the contract value who are linked to the Russian Federation in the manner described in the notice. If the bid is a joint bid, a power of attorney for the joint bidders must be attached.
