Compliance requirements
The bidder must confirm that none of the mandatory exclusion grounds under Section 95(1) of the Public Procurement Act apply, including convictions related to organised crime, corruption, fraud, terrorist offences, money laundering or terrorist financing, illegal employment of foreigners, child labour or human trafficking, tax or social security debt, or sanctions restrictions. The bidder must also confirm that none of the optional exclusion grounds under Section 95(4) apply, such as serious or repeated breach of earlier public contracts or false information / failure to submit required qualification documents. Subcontractors used for contract performance must also be free of these exclusion grounds.
Qualification criteria and exclusion grounds
The bidder’s net turnover for each of the last two completed financial years must be at least EUR 200,000. An extract from the reports for the last two completed financial years must be submitted showing the turnover; for a legal entity registered in Estonia, a separate extract may not be required if the data are publicly available to the contracting authority from a data register. If the financial year does not coincide with the calendar year, the requirement applies to the last two completed financial years. At least 6 months must have passed since the end of the last completed financial year by the bid submission date.
During the 60 months before the start of the procurement, the bidder must have properly performed at least 3 similar electrical construction contracts, at least 1 of which must have a value of at least EUR 40,000 excluding VAT. A list of the contracts must be submitted, including the performance period, details of the other contracting party (including the client representative’s contact details) and, in public procurements, the reference numbers. The contracting authority may request evidence of proper performance.
The bidder must have a person managing electrical works with a valid A-competence certificate or a qualification corresponding to at least level 6 under the Occupational Qualifications Act, and that person must be added to Elektrilevi’s partner portal before bid opening. A foreign bidder must submit confirmations and documents proving equivalent competence.
The bidder must have a designated responsible person for the work operation (C-person), and that person must be entered into the EPP environment before bid opening.
The bid must include the completed price offer table in Form 1 and the technical information in Form 2. The bidder must also provide the names and contact details of the contract signatory or signatories and the contact person for contract performance; if the right of representation does not arise from the articles of association, a power of attorney must be included.
