Compliance requirements

A bidder may be excluded if the company, its management, supervisory or representative persons have a final conviction within the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences or related acts, or if the exclusion period in the judgment is still in force. If an exclusion ground applies, the bidder may be allowed to prove self-cleaning measures where the procurement rules permit it. Qualification criteria and exclusion grounds
The bidder’s net turnover in the field of green area maintenance work in each of the last two completed financial years must be at least EUR 100,000. The bidder must provide turnover data for those two years and, if the data are not available from a public register, the contracting authority may require annual reports or extracts. The bidder must have carried out, within the last three years and during at least one vegetation period, green area maintenance in an urban settlement covering at least 30 hectares in accordance with the second maintenance class described in the tender documents. A list of previous services must be submitted, including volume, period and clients, together with client confirmations and the procurement reference number where applicable. For contract performance, the bidder must have one designated site manager with at least 5 years of experience in organising public green area maintenance work, and the managed work volume must have been at least 15 hectares during one vegetation period. The bidder must also describe the machines, equipment and labour resources to be used, and confirm that the bid complies with all conditions set out in the tender documents. In the case of a joint bid, a power of attorney from the joint bidders must be submitted. If the bid is signed by a person without signing authority, a power of attorney proving representation rights must be attached.
