Compliance requirements
The notice includes the standard exclusion grounds, especially convictions for participation in a criminal organisation, corruption, fraud and other mandatory exclusion grounds under the Public Procurement Act. If an exclusion ground applies, the bidder may be able to provide evidence of self-cleaning, where allowed by law or the tender documents. The machine-readable notice does not give the full list in the excerpt, so the exact exclusion grounds must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register of its country of establishment or in the Estonian commercial register, where applicable. If the bidder is not registered in the Estonian commercial register, it must provide a register extract or other equivalent proof showing the business name, registration code, address, members of the management body and persons authorised to represent it. If the document is not in English, an Estonian translation must be provided.
Financial requirement: the bidder’s net turnover for each of the last three financial years ended by the time the procurement started must be at least EUR 500,000 per year. If needed, the bidder must provide an extract from the annual accounts or another proof if turnover is not publicly available in the commercial register.
Technical capacity: the bidder must have performed at least one sales contract in the last 36 months whose subject was the sale of a bus simulator together with simulation software. The simulator must have been delivered to and accepted by the customer within that 36-month period. The bidder must provide a short description of the contract, its value, dates and the other contracting parties.
For bid compliance, the bidder must complete the technical specification bid form and attach the confirmations, data, documents and drawings required there. If the proposed solution relies on equivalence, the bidder must clearly explain it and attach proof. If the bid is submitted by someone other than the legal representative, a power of attorney must be provided. In the case of a joint bid, a power of attorney for the joint bidders, the ESPD documents of all joint bidders and information on each bidder’s share of the contract must be submitted. If the bidder relies on the resources of another entity, that entity’s consent, confirmations and ESPD must be provided. In addition, the bidder must confirm that it will not use subcontractors or suppliers subject to the specified Russia-related sanctions and that the offered goods are not subject to international sanctions and do not originate from sanctioned areas. The exact details must be checked in the tender documents if anything is unclear or missing in the machine-readable notice.
The machine-readable notice does not include precise requirements for every item, so the exact conditions must be checked in the tender documents if needed, especially for any missing details.
