Compliance requirements
The bidder must confirm that none of the exclusion grounds under Section 95(1) of the Public Procurement Act apply. In practical terms, this means the bidder and its relevant managers or legal representatives must not have convictions for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing; for enabling illegal employment or paying wages below the legal minimum to a foreign national; or for illegal use of child labour or human trafficking. The bidder must also not have tax, environmental charge or social security contribution debts, and neither the bidder nor a relevant management body member may be subject to an international sanction.
Qualification criteria and exclusion grounds
The bidder must have properly performed at least 1 similar contract within the 36 months preceding the publication date of the contract notice. A similar contract means the creation of a website that is viewable on different devices, complies with WCAG level AA or equivalent, and is in line with GDPR requirements. The contract value must be at least EUR 10,000 excluding VAT. The bidder must provide the completed contract details: the client’s contact details, contract dates, contract value and a description of the work performed. A CV must be submitted for the developer, showing experience of developing at least one website within the last 36 months, together with the website address and the client’s contact details. The machine-readable notice did not include any other precise qualification or suitability requirements; these must be checked in the tender documents.
