Compliance requirements
The bidder must confirm that none of the exclusion grounds listed in Section 95(1) points 1–3 and 5 of the Public Procurement Act apply, taking into account Section 95(2). The bidder must also confirm that it is not bankrupt or in liquidation, that bankruptcy or liquidation proceedings have not been initiated against it, and that its business has not been suspended or it is not in a similar situation under the law of its country of establishment. The bidder must confirm that it has no tax, environmental charge, social security or other public-law payment arrears under the law of its country of establishment. In addition, the bidder must confirm that its employees’ average wage during the reference period was above 70% of the average wage for the same period in the relevant field, and this must be proved with a Tax and Customs Board extract. The bidder must also confirm that it is not a related person to the technical consultant advising the beneficiary on the reconstruction of the apartment building. The machine-readable notice did not include more precise exclusion requirements; they must be checked in the official tender documents.
Qualification criteria and exclusion grounds
The bidder must be registered in the business register for construction activities covering general construction, indoor climate systems, and water supply or sewerage systems within buildings or connected to them. For electrical works, the bidder must also have a registration for electrical works covering the construction, including installation, of electrical installations; this registration requirement does not apply to foreign bidders, but equivalent proof of competence must be provided where relevant.
The bidder’s net turnover for the financial year preceding the submission of the bid must be at least equal to twice the expected contract value excluding VAT. In addition, by the date of signing the construction contract, the bidder must be able to provide, on first demand, a guarantee letter from a credit institution, financial institution or insurance company in the amount of 5% of the construction contract value excluding VAT. The guarantee must remain valid for the entire construction period and may also be provided by depositing the corresponding amount. If the contract is signed before the guarantee is submitted, the guarantee must be provided within 10 calendar days.
Within the 60 months before the start of the procurement procedure, the bidder must have carried out at least one equivalent construction work with a value of at least half of the expected contract value. Equivalent work means the erection, extension or full reconstruction of a building as the main contractor, and it must include at least the construction or reconstruction of the building’s load-bearing structures and external envelope, forced ventilation with heat recovery, and a new heating system. The bidder must provide the project name, building details, time and value of the work, and explain which of the listed elements were included.
The bidder’s team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and, for electrical works, a competent person. The project manager must have at least a level 6 construction engineer qualification specialising in building construction or a level 6 construction manager qualification specialising in general construction. The site manager must have at least a level 5 construction foreman qualification specialising in general construction works. The ventilation and heating systems specialist must have at least a level 6 heating, ventilation and cooling engineer qualification with the relevant management competences, or a level 6 construction manager qualification specialising in indoor climate systems. The water supply and sewerage systems specialist must have at least a level 6 water supply and sewerage engineer qualification or a level 6 construction manager qualification with the relevant specialisation. The person involved in electrical works must have at least a class B competence certificate or a level 6 electrical engineer qualification in consumer electrical installations. For each role, the bidder must provide the person’s name and the number of the professional or competence certificate; equivalent competence is accepted for foreign bidders.
The bidder must have a quality management system implemented in the field of construction works that complies with at least EVS-EN ISO 9001, and an environmental management system that complies with at least EVS-EN ISO 14001, or equivalent requirements. A certificate or copy of the relevant proof must be submitted. The machine-readable notice did not include precise qualification, suitability or compliance requirements; these must be checked in the official tender documents.
