Compliance requirements
The contracting authority will check the exclusion grounds under Section 95(1) of the Public Procurement Act for the successful bidder before signing the contract. If the data cannot be obtained through official queries, the successful bidder must provide the relevant data or documents before contract award. The procurement applies the self-cleaning rules under Section 97. The bidder must confirm that neither it nor any joint bidder is subject to the exclusion grounds and, if needed, provide justified evidence of self-cleaning measures.
Qualification criteria and exclusion grounds
The bidder must have the manufacturer’s right to sell the contract subject and provide product support in the territory of the Republic of Estonia. To prove this, the bidder must submit a copy of the document or a link to the manufacturer’s or cooperation partner’s website. If the right is granted for representation of the manufacturer in the European Union or is evidenced through a cooperation partner, the bidder must also provide the manufacturer’s confirmation or website reference and, in addition, the cooperation partner’s confirmation or website reference showing cooperation with the bidder. The bid must remain valid for 3 months. The bidder must provide the name of the contract signatory, the basis for signing, the signatory’s job title, the contract performance contact person’s details, and the bank account number. If the bidder has representation or control persons not shown in the commercial register, their name, personal identification code and basis of representation must be provided. The bidder must confirm that its own, joint bidders’ and possible subcontractors’ place of residence or establishment is in the permitted countries, that the bid complies with the procurement documents and, where necessary, that equivalence has been demonstrated. If this is a joint bid, a power of attorney for the joint bidders must be attached. The bidder must also confirm that subcontractors and suppliers linked to the Russian Federation will not be involved for more than 10% of the contract value.
