Compliance requirements
The tender documents include standard exclusion grounds. The bidder must confirm that neither the company nor its management, administrative or supervisory body members, nor persons authorised to represent, decide for or control the company, have been finally convicted in the last five years for offences such as participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering, child labour or human trafficking, or other grounds listed in the procurement documents. The notice also refers to self-cleaning: if an exclusion ground exists, the bidder may provide evidence of measures taken to restore reliability, where allowed by law or the tender documents.
Qualification criteria and exclusion grounds
The bidder’s net turnover for each of the last 2 financial years ended by the start of the procurement must be at least EUR 100,000. If turnover data are not publicly available in the Commercial Register, the successful bidder must submit extracts from the annual accounts. The previous-experience requirement is that the bidder must have at least 3 properly performed contracts in the last 3 years for the sale of firefighting clothing jackets and trousers, and each contract must cover at least 200 sets. No additional experience documents need to be submitted with the tender, but the contracting authority may verify the information provided. The tender must remain valid for 3 calendar months from the submission deadline. If the tender is joint, an authorised representative must be appointed and a power of attorney from the joint bidders must be attached. The bidder must also submit one new sample set of forest firefighting clothing in size L for height 180–188 cm, together with a copy of a certificate issued by an independent accredited laboratory or body proving compliance with EN ISO 11612:2015, EN ISO 13688:2013, EN ISO 15384:2020 and EN 1149-5:2018 or equivalent standards, and with Directives (EU) 2016/425 and (EC) 765/2008. The certificate must be in Estonian or English; if it is in another language, a translation must be attached. The bidder must also confirm that the offered goods are not subject to international sanctions and that subcontractors or suppliers linked to the Russian Federation will not be involved for more than 10% of the contract value. The tender must comply with all conditions set out in the procurement documents.
