The bidder must confirm that none of the exclusion grounds listed in Section 95(1)(1)–(5) of the Public Procurement Act apply to it. This means, among other things, that neither the bidder nor its authorised representatives have been convicted for participation in a criminal organisation, corruption, fraud, terrorism, money laundering, illegal employment of foreign workers, human trafficking, or tax debt, and that awarding the contract would not breach an international sanction or a sanction imposed by the Government of the Republic.

The bidder must be registered in the commercial register or another equivalent register in its country of establishment, if this is required by the laws of that country. For bidders registered in Estonia, the contracting authority checks the data itself. A foreign bidder must confirm that it is entered in the register required by the laws of its country of establishment. In addition, service, annual inspection and any necessary repair of the respirators must take place in Estonia, either at the contracting authority’s site or at the bidder’s service point. The bidder must confirm that it has a service point in Estonia. The bid must be submitted in the form required by the tender documents. The bidder must provide documents confirming the type of the offered test equipment and breathing apparatus, such as the technical description and user manual, and complete the compliance form.
