Compliance requirements
The machine-readable notice includes mandatory exclusion grounds such as participation in a criminal organisation, corruption, fraud and other standard conviction-based grounds. The bidder and its management/representation persons must confirm that none of these grounds apply. If a ground applies, the bidder may need to explain any self-cleaning measures and provide supporting evidence where allowed. The exact list continues in the tender documents and must be checked there.
Qualification criteria and exclusion grounds
The bidder must have completed at least 2 sales or rental contracts for Microsoft or equivalent software licences within the 36 months preceding the start of the procurement. Each contract must have a value of at least EUR 300,000 excluding VAT. If a contract is still being performed, the required volume must already have been completed. A list of those contracts must be provided, including their values, performance periods, dates and the contact details of the other contracting parties; for a public procurement contract, the procurement reference number must also be stated. In addition, the bidder must have Microsoft-issued sales authorisation for licensing solutions (License Solution Provider) in order to offer software licences under the Enterprise Subscription Agreement in the Estonian region. If the bidder does not have a direct manufacturer authorisation or certificate, it must provide the relevant authorisation or other proof. The tender price must be submitted according to the structure of form 2, with unit prices and a total price in euros excluding VAT and to two decimal places. If an equivalent solution is offered, evidence of equivalence and a migration plan with activities, time and costs must be included. The bid must comply with all requirements set out in the procurement documents.
