Compliance requirements
The tender documents include the standard exclusion grounds, especially criminal convictions such as participation in a criminal organisation, corruption, fraud and other mandatory exclusion grounds under Estonian procurement law. If an exclusion ground applies, the bidder may be able to provide evidence of self-cleaning, but the exact conditions must be checked in the tender documents.
Qualification criteria and exclusion grounds
To make the bid compliant, the bidder must submit a bid meeting the technical requirements in Annex 1, the manufacturer’s detailed technical description and instructions for use, and other Estonian- or English-language materials proving compliance with the required characteristics. If the description contains manufacturer-specific terms, an explanatory note on their meaning must be added. If the bidder is not the manufacturer, it must have the manufacturer’s or authorised representative’s written consent to offer the capsules on the bidder’s proposed terms. In a joint bid, the bidders must appoint a representative from among themselves and submit the joint bidders’ power of attorney and the statement on joint and several liability in Annex 3 form I. The bidder must also submit the application for participation in the procurement in Annex 3 form II and confirm that the bid complies with the procurement documents and that no conditional bid is submitted. The machine-readable notice did not include precise selection or suitability criteria; these must be checked in the tender documents.
