Compliance requirements
The bidder must confirm the mandatory exclusion grounds, especially that neither the company nor its management, supervisory or representative persons have been finally convicted in the last five years for participation in a criminal organisation, corruption, fraud and the other listed criminal offences. If an exclusion ground exists, the bidder may provide evidence of self-cleaning, and the notice says this may be possible if the procurement is above the international threshold or if the contracting authority has allowed it in the tender documents. Qualification criteria and exclusion grounds
The bidder must submit the descriptions, manufacturer information materials and other evidence needed to assess compliance, so that the contracting authority can verify that the offered medicine meets the requirements in the tender documents. The bidder must confirm that the bid complies with all tender document conditions and, where necessary, explain equivalence and attach evidence of it. The bidder must hold a wholesale distribution licence for medicines issued by the Estonian Medicines Agency in Estonia. The bidder must also have the right to market the offered medicines in Estonia; if a medicine is not registered with the Estonian Medicines Agency, a valid legal basis for marketing it in Estonia must be proven. If the bid is submitted as a joint bid, a joint bidders' power of attorney must be attached. If the person signing the bid is not shown as authorised in the register, a power of attorney for representation must be submitted.
