Compliance requirements
The machine-readable notice includes the standard exclusion grounds, including participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering and terrorist financing, and other mandatory exclusion grounds. If an exclusion ground applies, the bidder may be allowed to demonstrate self-cleaning where the procurement documents provide for it or where the law allows it. The exact wording and any additional exclusion grounds must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder’s total turnover from all business activities for the last three completed financial years must be at least EUR 150,000. If the information is not available from a public register, the contracting authority may request the annual reports for the last three financial years or extracts from them.
Within the 36 months before the start of the procurement, the bidder must have properly completed at least 1 construction contract for the construction of a publicly accessible park, playground or sports ground and their surfacing, with a contract value of at least EUR 40,000 excluding VAT. The bid must include a short description of the contract, the parties to the contract, the client representative’s contact details and, in the case of a public procurement, the reference number. The contracting authority may request evidence of proper performance.
The person responsible for managing the construction works, i.e. the project manager, must have at least road engineer level 6 professional qualification, except for the initial qualification, or an equivalent qualification. If the specialist is not employed by the bidder, the bid must include that person’s digitally confirmed consent to participate in the performance of the contract.
The bid must comply with the tender documents, be unconditional, and where necessary the bidder must provide explanations and evidence of equivalence. If subcontracting is used, the subcontractor’s details and the required form must be submitted. The bidder must also confirm that no subcontractor subject to replacement under Section 122(7) of the Public Procurement Act will be used, and that the offered goods are not the object of international sanctions and do not originate from a sanctioned area.
