Compliance requirements
The bidder must confirm the standard exclusion grounds, including no final conviction in the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering, child labour or human trafficking, and the other mandatory exclusion grounds listed in the tender documents. If an exclusion ground exists, the bidder may need to show self-cleaning measures where allowed. The machine-readable notice did not include the full list in one place, so the exact exclusion grounds and any required confirmations must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder’s net turnover for the last financial year ended by the start date of the last three procurement procedures must be at least EUR 170,000 per year. Joint bidders may aggregate turnover. The bidder must provide in the ESPD data on the net turnover for each of the last three completed financial years.
The bidder, or the joint bidders as a whole, must have at least 1 properly completed contract for construction works on a public road within the 60 months before the start of the procurement procedure. The work may have started earlier, but it must have been completed by the day the contract notice was published. Road maintenance contracts do not qualify. The bidder must provide a short description of the contracts, the performance period, the client’s contact details and, where applicable, reference numbers, and must submit evidence of proper performance if requested by the contracting authority.
To perform the contract, the bidder or joint bidders must have a responsible site manager on site with at least level 6 road engineer professional qualification, specialisation in road construction and maintenance, selected competence in construction management, or equivalent. The responsible project manager with the same qualification must be present during the site visit. The bidder must provide this person’s details in the ESPD. The contracting authority will verify the qualification itself on the Estonian Qualifications Authority website.
The bid may be submitted only after the site visit, and the certificate issued by the contracting authority after the visit must be included with the bid. If the bid is submitted by a person without representation rights in the register, a power of attorney must be attached. In the case of a joint bid, a joint power of attorney must be attached and the leading joint bidder must be identified. The bid must comply with all tender document requirements, conditional bids are not allowed, and the price must be submitted in the required structure. The bidder must also confirm equivalence where used and provide the required confirmations regarding sanctions and non-inclusion of a subcontractor subject to replacement due to exclusion grounds.
