Compliance requirements
The bidder must confirm that none of the exclusion grounds apply. The notice lists criminal convictions for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing; offences related to illegal employment of foreigners or underpaying foreign workers; child labour or human trafficking; tax, environmental or social security debt; and sanctions that would make the contract unlawful. The bidder must also confirm the absence of false information about exclusion grounds or compliance with qualification requirements. In a joint bid, all joint bidders must submit the confirmations on the required form.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register of an EU Member State, an EEA contracting state or a WTO GPA member state, if this is required by the laws of the bidder’s country of establishment. An Estonian bidder does not have to submit a copy of the registration certificate, but the contracting authority may request it. If the bidder relies on the capacities of another company, it must provide details of that entity and also submit that entity’s confirmations on form HD Annex 5.1. The bidder’s net turnover in the sales of electrical equipment during each of the last three completed financial years before the start of the procurement (2023, 2024, 2025) must have been at least EUR 400,000 per year excluding VAT; if the financial year does not run from 1 January to 31 December, the data must be provided for the relevant financial-year period. The bidder must be the manufacturer of the offered products or the manufacturer’s authorised reseller, partner or representative, and must have the right to deliver the product to Estonia. On request, the bidder must provide a registration certificate, turnover evidence or proof of sales rights. In a joint bid, a power of attorney for the joint bidders’ representative must also be submitted if applicable.
