Compliance requirements

The bidder must confirm the standard exclusion grounds, including that neither the company nor its managers, board members, supervisory board members, proxies or other authorised representatives have been finally convicted in the last five years for offences such as participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering, child labour or human trafficking, where these grounds are listed in the tender documents. If an exclusion ground applies, the bidder may have to show self-cleaning measures. Qualification criteria and exclusion grounds

The bidder’s average annual turnover in the relevant field for the last financial year completed by the start of the last three procurement procedures must be at least EUR 100,000. The bidder must also have performed at least two similar Microsoft software licence sale or rental contracts during the previous 36 months. Similar contracts are contracts for Microsoft 365, Office 365 or Azure licences where the bidder supplied licences to at least 100 users or where the annual contract value was at least EUR 20,000 excluding VAT. The bidder must submit a list of completed contracts with information on their value, dates and other contracting parties, and in public procurement also the reference numbers. Under the compliance requirements, the bidder must confirm that the tender complies with the procurement documents, that equivalence has been explained where necessary, that a power of attorney has been attached in the case of a joint tender, that any trade secret has been justified where applicable, and that the offer does not involve subcontractors or suppliers linked to the Russian Federation for more than 10% of the contract value, nor goods that are subject to sanctions.
