Compliance requirements
The machine-readable notice includes the standard exclusion grounds from the tender passport, including participation in a criminal organisation, corruption, fraud, money laundering or terrorist financing, child labour and other forms of human trafficking, and terrorist offences. The bidder must confirm whether any of these grounds apply to the company or to its management, legal representative or controlling persons. If an exclusion ground applies, the bidder may also need to provide information on self-cleaning measures and, where relevant, the conviction date, reason, person convicted and the exclusion period. The exact wording and any additional grounds must be checked in the official tender documents.
Qualification criteria and exclusion grounds
The bidder must demonstrate technical and professional capability with at least two similar construction contracts performed as the main contractor within the 60 months preceding the start of the procurement procedure. For these contracts, the bidder must provide a description, total amount, currency, the bidder’s scope of responsibility, amount, time period and, where relevant, the client and contact details. During performance of the works, the bidder must involve a construction project manager who is a certified road engineer, level 7, with a specialisation in road construction and maintenance and competence in managing construction activities. Under the compliance requirements, the bidder must confirm that the bid complies with the tender documents, that conditional bids are not allowed, that in a joint bid the joint bidders’ power of attorney has been attached, and that equivalence has been explained and supported by evidence where necessary. As for trade secrets, the bid price and other numerical indicators used for evaluation may not be marked as confidential.
