Compliance requirements
The bidder must not have the exclusion grounds listed in Section 95(1) points 1–5 and Section 95(4) point 12 of the Public Procurement Act. The bidder must confirm the absence of these grounds in the procurement register. If there are other persons in the bidder’s company who are authorised to represent the company, make decisions on its behalf or control it, and who are not visible to the contracting authority from the commercial register card, the bidder must provide the authorised person’s name and personal identification code, or confirm that no such persons exist.
Qualification criteria and exclusion grounds
The bidder must have at least 1 completed contract during the 36 months preceding the deadline for publication of the contract notice, under which at least one modular building or element building was procured, delivered and installed for a total value of at least EUR 60,000 excluding VAT. If the experience comes from orders performed under a framework agreement, the bidder may prove qualification through those completed orders.
The bidder must submit the completed contract details on the contracting authority’s form Annex 3: a short description of the contract, value, performance period and details of the other contracting party, including the client representative’s contact details and, in the case of a public procurement, the reference number.
If the bidder relies on the capacities of another entity, the bidder must submit the consent of that entity’s legal representative in the form of Annex 4. If the bidder relies on a contract performed by another entity, that entity must be indicated as a subcontractor and the reliance must be marked in the register.
In the case of a joint bid, Annex 5 must be submitted with information on the size and nature of the part to be performed by each joint bidder.
The person responsible for the installation works of the modular building must have at least level 6 professional qualification as a construction engineer, specialised in building construction, in the occupation of construction management or site management, or an equivalent qualification. The bidder must also provide a drawing of the modular building with all dimensions, equipment list and layout, and the external connection points for utilities and communications.
The machine-readable notice did not include precise compliance requirements beyond these points; the official tender documents should be checked for any additional requirements.
