Compliance requirements

The bidder must confirm that none of the exclusion grounds apply. The notice lists criminal convictions, illegal employment of foreign nationals, illegal use of child labour or human trafficking, tax or social security debts, and situations where the contract would breach international or government sanctions. The bidder must also confirm the required declarations on the prescribed form for all joint bidders, if applicable.

Qualification criteria and exclusion grounds

The bidder must be registered in the business register of an EU, EEA or WTO GPA member state, if this is required by the laws of the bidder’s country of establishment. An Estonian bidder does not have to submit a copy of the registration certificate unless requested by the contracting authority. The bidder must hold a valid railway freight service operating licence, a safety certificate and an established transport rules document. A foreign bidder must provide the relevant evidence and copies of the required documents. The bidder must own, or have the right to use, a locomotive that may operate on both the Estonian Railways and Russian Railways infrastructure. The locomotive must be owned by the bidder or available under a usage right, registered in the required register, meet the traction requirement, comply with the axle load limit of up to 23 tonnes, and be equipped with the required safety devices or additional equipment. The bidder must provide the locomotive’s technical data and documents proving the right to use it. If the bidder relies on the capacities of another undertaking, the declarations of that entity must also be submitted. The tender must comply with the procurement documents, and where necessary equivalence must be explained and proven. The bidder must also submit the application to participate in the tender, the bid price in the required structure, and, in the case of a joint bid, the power of attorney.
