Compliance requirements
The tenderer must confirm that none of the mandatory exclusion grounds apply, including criminal convictions of the company or its representatives, illegal employment-related offences, child labour or human trafficking offences, tax or social security debts, and international sanctions status. The tenderer must also confirm that none of the voluntary exclusion grounds apply, such as serious breaches of environmental, social or labour law, bankruptcy or liquidation, serious professional misconduct, collusion, conflicts of interest, prior contract breaches, false information, attempts to influence the contracting authority, tax offences, or lack of the right to submit a tender.
Qualification criteria and exclusion grounds
The bidder’s net turnover for each of the last three completed financial years must be at least EUR 200,000 per year. An extract from the financial statements for the last three completed financial years must be submitted, showing the turnover; for a legal entity registered in Estonia, this may not be required if the data are publicly available to the contracting authority. If the financial year does not coincide with the calendar year, the requirement applies to the last three completed financial years. At least six months must have passed since the end of the last completed financial year by the tender submission date.
Within the 60 months preceding the start of the procurement, the bidder must have properly performed at least three contracts for similar electrical construction works, at least one of which must have had a value of at least EUR 200,000 excluding VAT. A list of the contracts must be submitted, including the performance period, details of the other contracting parties, including the client representative’s contact details, and, in the case of public procurements, reference numbers. The contracting authority may request evidence of proper performance.
The tender must include the price table in the format required by the tender documents, with all unit price fields completed. The bidder’s team must include a person with valid switching authorisations who has been entered into Elektrilevi’s partner portal before the tender submission deadline. There must also be a person appointed as responsible for the work operation, entered into the partner portal before the deadline. In addition, the team must include a leading electrical works person with valid A-competence or at least level 6 qualification, who has the relevant proof at the time of tender submission and has been added to the partner portal before the deadline.
The bidder must provide the names, job titles and contact details of the person(s) signing the contract, as well as the contact person for matters related to contract performance. If the right of representation does not arise from the articles of association, a power of attorney must be included. In the case of a joint tender, a joint tenderers’ power of attorney must be attached. The tender must comply with all conditions set out in the tender documents, and alternative or conditional tenders are not permitted.
