Compliance requirements

The bidder must confirm that none of the exclusion grounds listed in the Public Procurement Act apply, including bankruptcy or liquidation, suspension of business, and tax or social security debt. The bidder must also confirm that its average wage during the reference period was above 70% of the average wage in the relevant sector, and provide evidence from the Tax and Customs Board or an equivalent authority for foreign bidders. In addition, the bidder must confirm that it is not a related person to the technical consultant advising the beneficiary on the apartment building reconstruction. Qualification criteria and exclusion grounds

The bidder must be registered in the construction activity area for general building works, indoor climate systems, and internal or associated water supply or sewerage systems. For foreign bidders, the Estonian economic activity register requirement does not apply, but equivalent proof of competence must be provided if relevant. When carrying out electrical works, the bidder must have a registration for electrical works covering the construction, including installation, of an electrical installation. A foreign bidder may again provide equivalent proof. The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the expected contract value excluding VAT. The exact amount must be stated to the nearest euro. By submitting a bid, the bidder must accept the condition that by the contract date, or within 10 calendar days after contract signature, it must be able to provide a performance security equal to 5% of the contract value. The security may be a bank or financial institution guarantee, a deposit into the beneficiary’s bank account, or a deposit into a notary account, provided that the beneficiary remains the entitled party throughout the construction period. Within the 60 months before the start of the procurement procedure, the bidder must have completed at least one equivalent construction project with a value of at least half of the expected contract value excluding VAT. An equivalent project means the construction, extension or full reconstruction of a building as the main contractor, and it must include at least the construction or reconstruction of the building’s load-bearing and external envelope structures, mechanical ventilation with heat recovery, and a new heating system. The bidder must provide the building name, execution period and value, and evidence in the form of a use notice, use permit or a handover-acceptance certificate. The bidder’s team must include a project manager with at least level 6 construction engineer qualification specialising in building construction, or level 6 construction manager qualification specialising in general building works; for a foreign bidder, an equivalent qualification is acceptable. The team must also include a site manager, a ventilation and heating systems specialist, a water supply and sewerage systems specialist, and a competent person for electrical works. For each of these roles, the bidder must provide the person’s name and the number of the professional or competence certificate. In addition, the team must include a level 7 authorised architect responsible for the project’s compliance with the requirements of the New European Bauhaus. The bidder must have a quality management system and an environmental management system implemented in the construction activity area.
