Compliance requirements
The bidder must not have the exclusion grounds listed in Section 95(1) points 1–5 and Section 95(4) point 12 of the Public Procurement Act. The bidder must confirm in the procurement register that none of these grounds apply. If the bidder has other persons in the company who are authorised to represent the company, make decisions on its behalf or control it, and who are not visible to the contracting authority from the commercial register card, the bidder must provide the authorised person’s name and personal identification code, or confirm that no such persons exist.
Qualification criteria and exclusion grounds
The bidder must have, within the 36 months before the start of the procurement, at least 2 completed waste management service contracts, each worth at least EUR 50,000 excluding VAT. If a contract extended beyond the reference period, only the waste management services provided during the relevant 36 months count, and they must amount to at least EUR 50,000 per contract. A list of contracts must be submitted on the Appendix 4 form, including the contract value, signing dates and details of the other contracting party. If the bidder relies on another company’s experience, that company’s consent must be provided, and where relevant the subcontractor details and, for joint bidders, the size and nature of each party’s share must be included. The bidder must have a quality management system in the waste handling field that complies with ISO 9001 and ISO 14001 or equivalent standards, and the relevant certificates or evidence must be submitted. The bidder or its subcontractor must have a valid environmental permit entered in the KOTKAS register; if the bidder or subcontractor is not based in Estonia, evidence from the competent authority in the country of establishment must be provided. The bid must also include a service plan and evidence or a declaration that at least 10% of the service will be performed with environmentally friendly N2 or N3 category road vehicles, if more than five such vehicles are used. In the case of a joint bid, a joint bidders’ power of attorney must be attached. The bid must comply with the requirements in the tender documents and, where necessary, equivalence must be explained and evidence provided.
