Compliance requirements
The bidder must confirm the mandatory exclusion grounds in the tender documents, including participation in a criminal organisation, corruption, fraud and the other criminal-conviction grounds listed in the ESPD. The compliance conditions do show that the bid must match the technical specification, the bidder must complete Appendix 1 Technical Specification and Appendix 2 Price Form, and must attach the manufacturer’s technical documentation and, where relevant, proof of equivalence. The bidder must be the manufacturer’s official representative and provide the manufacturer’s confirmation of representation and sales rights. In the case of a joint bid, a authorised representative must be appointed and a power of attorney from the joint bidders must be attached. The bid must be unconditional and include the required contact person details.
