Compliance requirements
The machine-readable notice lists standard exclusion grounds such as participation in a criminal organisation, corruption, fraud and other mandatory exclusion grounds. The bidder or its managers, legal representatives or persons with authority to represent or control the bidder must not have a relevant final conviction within the last five years, unless the exclusion period has expired. If an exclusion ground exists, the bidder may be allowed to show self-cleaning measures where the law or tender documents permit it. The exact exclusion grounds and any self-cleaning conditions must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must demonstrate financial and technical capacity and provide the required data in the tender passport and forms.
- The total annual turnover for each of the last three completed financial years must be at least EUR 140,000 per year. The tender passport must include the net turnover figures for 2025, 2024 and 2023.
- Within the 36 months before publication of the contract notice, the bidder must have completed at least 3 similar sales-and-installation contracts, each worth more than EUR 70,000. Similar contracts are defined as furniture manufacturing or sales combined with installation.
- For references, the bidder must provide a list of contracts with the partner names, object, value and duration; for contracts awarded through public procurement, also the procurement reference number. The contracting authority may request a confirmation letter from the client or buyer.
- The bid must comply with all requirements set out in the procurement documents, and where necessary the bidder must include an explanation of equivalence and supporting evidence.
- The bidder must submit Form 2 participation declaration, Form 3 price information, Form 9 product data, and, in the case of a joint bid, Form 8 authorisation and joint-liability confirmation.
- The furniture must carry at least a 5-year warranty, spare parts or equivalent components must be available for at least 5 years, and disassembly and repair instructions must be provided.
- For REACH candidate substances, the bidder must submit a declaration or confirm that the products do not contain such substances above 0.1% by weight.
- For wood and wood-based materials, lawful origin must be proven with FSC, PEFC, CSA, SFI, FLEGT, CITES or equivalent evidence; for uncertified wood, the species, quantities and origin must be provided and legality confirmed by the bidder.
