Compliance requirements
The bidder must confirm the mandatory exclusion grounds listed in the tender documents, including convictions for participation in a criminal organisation and corruption. If an exclusion ground applies, the bidder may be allowed to provide evidence of self-cleaning, if this is permitted by the procurement documents or by law. The machine-readable notice did not include the full list of exclusion grounds, so the official tender documents must be checked.
Qualification criteria and exclusion grounds
The bidder must involve at least one specialist for the design work with the following or equivalent qualification: chartered civil engineer, level 7, with competence in preparing building design projects. The details of the competent person must be provided in the ESPD, and a copy of the diploma or professional certificate must be attached to the bid. This requirement applies to all three lots: Hariduse tn 21, Kajaka tn 17a and Kesk tn 30.
If the bidder uses subcontractors or relies on their capacity, it must state the subcontracted share as a percentage of the total contract value and submit the subcontractor’s consent. In that case, a separate ESPD must be submitted for each subcontractor. The contracting authority will also check subcontractors for exclusion grounds and for compliance with the conditions on which the bidder relies.
The bid must be submitted in the required composition, include all required documents and forms, and comply with the tender documents. If the bid is submitted by a person whose right of representation does not arise from law, a proper power of attorney must be attached. In the case of a joint bid, a power of attorney for the joint bidders must be submitted. The bid price must be stated in euros, both without VAT and with VAT, to two decimal places, and must include all costs necessary to perform the works, including taxes, fees, overheads and profit. The bidder must also confirm compliance with the required terms and, where necessary, explain equivalence and attach supporting evidence of equivalence.
