Compliance requirements
The bidder must be excluded from the procurement procedure if any of the exclusion grounds listed in Section 95(1)(1)–(5) of the Public Procurement Act apply to it or its representative. This includes convictions related to participation in a criminal organisation, corruption, fraud, terrorism, money laundering, illegal use of labour, human trafficking, tax debt, or sanctions violations. The bidder must confirm that none of these exclusion grounds apply.
Qualification criteria and exclusion grounds
The bidder must be entered in the commercial register of its country of establishment if this is required by that country's law. An Estonian bidder does not need to submit a separate register extract.
The bidder and/or its subcontractor must have performed at least 1 similar contract within the last 60 months before the start of the procurement. The contract must have covered road construction, reconstruction or repair works, including the construction and/or restoration of gravel road surfaces. Form 2, 'List of contracts', must be submitted with the contract name, short description, performance period and the other contracting party.
The bidder and/or its subcontractor must have a qualified responsible person for the works. At minimum, this must include a person managing construction works who holds a Road Engineer, Level 6 professional certificate or an equivalent or higher qualification. Form 3, 'List of responsible specialists', and copies of documents proving competence must be submitted. A foreign bidder must submit copies of documents issued under the laws of its country of establishment and a confirmation that, within one month after signing the contract, it will submit the confirmation issued by the Consumer Protection and Technical Regulatory Authority regarding the qualification and competence of the above responsible person.
