Compliance requirements
The bidder must confirm that neither the bidder nor any entity whose resources it relies on has the exclusion grounds set out in Section 95(1) of the Public Procurement Act. The bidder must also confirm that neither it nor any such supporting entity has the exclusion ground under Section 95(4)(8) related to previous contract breaches. If the answer is no, the bidder must briefly describe the relevant grounds or breaches. The machine-readable notice did not include any more precise exclusion requirements; they must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder’s net turnover for each of the last two completed financial years must have been at least EUR 140,000; if the financial year follows the calendar year, those years are 2025 and 2024. The bidder must submit Form 1. The bidder must have properly performed at least one construction contract within the 60 months before the publication date of the contract notice, comparable to the subject of the tender: construction or repair of a building heating system together with the construction of a new central building automation system. For this experience, the bidder must provide a list of contracts with the partner details, object, closed net area, description of the works and contract period; if the contract was awarded through public procurement, also the procurement reference number. The contracting authority may request a client confirmation letter. For the works, the bidder must involve a project manager with at least Construction Engineer, Level 6 or Construction Manager, Level 6 with the relevant specialisation, and specialists responsible for heating systems and building automation whose qualifications match the certificates specified in the documents or are equivalent. The bidder must submit Form 4 for all involved specialists and, where certificates were issued outside Estonia, the additional proof required. In the case of a joint tender, Form 8 must be submitted. The tender must also include Form 2 and Form 3, and the price must be submitted in euros excluding VAT. The machine-readable notice did not include precise qualification and compliance requirements; they must be checked in the tender documents.
