Compliance requirements
The contracting authority will exclude a bidder if any of the exclusion grounds under Section 95(1) of the Estonian Public Procurement Act apply. This covers convictions or offences related to participation in a criminal organisation, breach of integrity duties or corruption, fraud, terrorist offences or related incitement/complicity/attempt, money laundering or terrorist financing, illegal employment of foreigners or enabling breaches of foreigner employment rules in Estonia, and illegal use of child labour or human trafficking. The bidder must also confirm that it has no tax, fee or environmental charge arrears, and that awarding the contract would not breach international sanctions or sanctions of the Government of Estonia. If the bid involves a foreign company, the bidder must submit documents proving the absence of exclusion grounds for that foreign company and, where relevant, its management and representative persons. If the contracting authority cannot verify the information from public registers, additional documents must be provided on request.
Qualification criteria and exclusion grounds
The bidder must have a total net turnover of at least EUR 2,400,000 for the last three completed financial years before the start of the procurement, with at least EUR 800,000 in each year. If the bidder is not an Estonian-registered legal entity, or if the information is not publicly available or cannot be checked in substance, the bidder must submit annual report extracts and/or other documents proving compliance. Joint bidders may rely on each other’s figures. The bidder must also confirm a previous contract: within the 60 months before the procurement notice date, it must have properly performed at least one substation construction contract for a 110 kV or higher-voltage substation, including design work, with a contract value of at least EUR 500,000 excluding VAT, and at least EUR 500,000 must have been paid under the contract. If the bidder relies on another entity’s experience or figures, that entity must provide a signed confirmation covering the absence of exclusion grounds, consent to reliance, how it will participate in performance, and joint liability. The bidder must submit the required price table, completed technical questionnaires for high-voltage equipment and relay protection/system automation, a financing schedule, and, if applicable, powers of attorney, joint bidder authorisations, and documents for foreign companies or hidden authorised representatives. The bid security is EUR 5,200.
