Compliance requirements
The bidder must confirm that none of the statutory exclusion grounds apply to it or, in the case of a joint bid, to any joint bidder. The bidder must also confirm that it is not bankrupt or in liquidation, that no bankruptcy or liquidation proceedings have been opened against it, and that its business is not suspended or in a similar situation under the law of its country of establishment. The bidder must confirm that it has no tax, fee, environmental charge, social security or similar payment arrears under the law of its country of establishment. In addition, the bidder must confirm that it is not a related party to the technical consultant advising the beneficiary on the reconstruction of the apartment building. The machine-readable notice also requires confirmation that the bidder’s average wage during the reference period was above 70% of the average wage for the same period in the relevant sector, and this must be supported by an extract from the tax authority.
Qualification criteria and exclusion grounds
The bidder must be registered in the business register for construction activities covering general building works, indoor climate systems, and internal or adjacent water supply or sewerage systems. For electrical works, the bidder must also have a registration for electrical works covering the construction, including installation, of electrical installations. For foreign bidders, the registration requirement does not apply, but equivalent competence must be demonstrated where relevant.
The bidder’s net turnover for the financial year preceding the submission of the bid must be at least equal to twice the estimated contract value excluding VAT. The bidder must also be able to provide a performance security of 5% of the contract value by the contract date or within 10 calendar days after contract signature; the security must remain valid for the entire construction period. A corresponding amount deposited on the beneficiary’s or a notary’s account is also accepted, provided the beneficiary remains the entitled party throughout the construction period.
Within the 60 months before the start of the procurement procedure, the bidder must have completed at least one comparable construction project with a value of at least half of the estimated contract value. A comparable project means the construction, extension or full-building reconstruction of a building as the main contractor, and it must include at least the construction or reconstruction of the load-bearing structure and external envelope, a heat-recovery ventilation system, and a heating system. The bidder must provide the project name, building details, execution time, value, and proof by means of a use notice, occupancy permit or a handover-acceptance certificate.
The team must include a project manager with at least level 6 professional qualification as a construction engineer specialising in building construction, or level 6 construction manager qualification specialising in general construction; a site manager with at least level 5 construction work manager qualification specialising in general construction works; a ventilation and heating systems specialist with at least level 6 qualification as a heating, ventilation and cooling engineer or level 6 construction manager qualification specialising in indoor climate systems; a water supply and sewerage systems specialist with at least the relevant level 6 engineering qualification or level 6 construction manager qualification; and a person involved in electrical works with at least a class B competence certificate or level 6 electrical engineer qualification for consumer electrical installations. For each role, the bidder must provide the person’s name and the number of the professional or competence certificate. For foreign bidders, an equivalent qualification is accepted.
The bidder must have a quality management system in the construction sector in accordance with EVS-EN ISO 9001 and an environmental management system in accordance with EVS-EN ISO 14001, or equivalent conditions.
The bid must also comply with the tender documents, and if the bidder relies on equivalence, supporting evidence must be included. In a joint bid, a power of attorney for the joint bidders and the required declarations for team members must be submitted, and the bid form must be completed on the beneficiary’s form, with all costs clearly shown by the cost lines set by the beneficiary.
