Compliance requirements
The bidder must confirm the mandatory exclusion grounds, including convictions for participation in a criminal organisation, corruption and fraud. If an exclusion ground exists, the bidder may provide evidence of self-cleaning measures. The notice also requires confirmation that the bidder does not use subcontractors or suppliers for more than 10% of the contract value who are Russian nationals, residents, or entities established in the Russian Federation, or who are owned or controlled by them, or act on their instructions.
Qualification criteria and exclusion grounds
The bidder’s net turnover for the last financial year ended by the start of the procurement must be at least EUR 60,000. Joint bidders may combine their turnover figures. To prove this, the bidder must provide the relevant data in the ESPD and, if requested by the contracting authority, the annual accounts or another supporting document.
The bidder must have at least 1 properly performed contract for the design of a public road construction project completed within the 36 months preceding the start of the procurement. If requested, the contracting authority may require a confirmation from the client that the contract was performed properly and that a public road construction project was prepared under it. If the bidder relies on another company’s resources, the bidder must also provide the details of that entity and, if requested, its consent.
The tender must include a fully completed HD IV handover and payment schedule for the works and work items in Excel format. The bidder may not modify the file except to enter the required data.
The bidder must confirm that it accepts the conditions set out in the contract notice and procurement documents, submits a tender only for the matters for which the contracting authority requested competing tenders, and indicates whether the tender contains trade secrets. In the case of a joint tender, a power of attorney and a separate ESPD for each joint bidder must be submitted. The names and personal identification codes of authorised persons must also be provided, or a confirmation that no such persons exist.
