The bidder must confirm that none of the mandatory exclusion grounds apply: no relevant criminal convictions of the bidder or its management/representation/control persons; no unlawful employment of foreigners or breach of foreign-worker employment rules, including payment below the statutory wage level; no offences related to illegal use of child labour or human trafficking; no tax, environmental charge or social security contribution arrears; and no conflict with international sanctions or sanctions of the Government of the Republic. The bidder must also confirm that its place of residence or establishment is not in a third country outside the countries allowed under the Public Procurement Act.

The machine-readable notice did not include precise selection or suitability criteria; these must be checked in the tender documents. As compliance requirements, the bidder must submit the completed Appendix 2 pricing form, confirm that the tender complies with the tender documents and that any equivalence has been explained with supporting evidence where needed, and provide a manufacturer-issued document proving the right to resell and provide product support in Estonia.
