Compliance requirements
The bidder must confirm that none of the mandatory exclusion grounds apply: no convictions for participation in a criminal organisation, corruption, fraud, terrorist offences or related offences, money laundering or terrorist financing; no convictions for enabling illegal employment of a foreign national staying without legal basis or for violating conditions of employment of a foreign national in Estonia, including paying less than the statutory wage rate; no convictions for illegal use of child labour or human trafficking; and no tax, fee, environmental charge, social security contribution or similar debt in the bidder’s home country. The contracting authority may also exclude a bidder if it has seriously or repeatedly breached an earlier public contract, leading to termination, price reduction, damages or contractual penalty, or if it has provided false information or failed to submit required supporting documents.
Qualification criteria and exclusion grounds
The bidder must have, during the 60 months preceding the start of the procurement, at least three properly performed contracts for electrical construction works similar to the subject of the contract, at least one of which must have a value of at least EUR 40,000 excluding VAT. A list of the contracts must be submitted, including the performance period, the other contracting parties’ contact details and, in public procurements, the reference numbers. The contracting authority may request evidence of proper performance.
The bidder’s team must include:
- a person with valid switching authorisations, entered in Elektrilevi’s partner portal before the deadline for submitting tenders; for low-voltage works only, at least low-voltage switching authorisations are sufficient, while in other cases both low-voltage and medium-voltage switching authorisations are required;
- a person appointed as responsible for the work operation, entered in Elektrilevi’s partner portal before the deadline for submitting tenders;
- a lead electrical worker with valid A-competence or, under the Vocational Education Act, at least level 6 qualification, who has the relevant certificate at the time of submission and is entered in Elektrilevi’s partner portal before the deadline for submitting tenders.
The tender must include a price table in the prescribed form, and all unit price fields must be completed. The tender must comply with all conditions set out in the tender documents, and conditional tenders or tenders with additional conditions are not allowed. If the bidder participates as a joint bidder, a joint bidders’ power of attorney must be attached. The bidder must also provide the names and contact details of the signatory(ies) and the contact person for contract performance, and a power of attorney if the right of representation does not arise from the articles of association.
