Compliance requirements
The machine-readable notice includes mandatory exclusion grounds for criminal organisation participation, corruption and fraud. The bidder or its management, supervisory or representative persons must not have a final conviction from the last five years for these offences, unless the exclusion period has already expired. If an exclusion ground applies, the bidder may submit evidence of self-cleaning, where allowed by law or the tender documents. The notice also indicates that the bidder must confirm the exclusion grounds in the tender documents.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register of its country of establishment. For each lot separately, the bidder must have sold similar equipment under at least 1 contract completed within the 36 months before the start of the procurement, and the contract value excluding VAT must have been at least EUR 15,000. The bidder must provide the confirmation and required details in the standard ESPD form. According to the compliance requirements, the bidder must submit the completed technical offer table showing the equipment model, required data and description, and the offer must remain valid for 90 days. The bidder must also confirm that the offered equipment complies with all applicable EU environmental requirements, including REACH, RoHS and WEEE, and that proper collection and recycling are ensured if needed. In the case of a joint bid, an authorised representative must be named and a power of attorney from the joint bidders must be attached. The bidder must also confirm that the offer complies with all tender document requirements and that it will not use subcontractors or suppliers subject to Russian-sanctions-related restrictions for more than 10% of the contract value.
