Compliance requirements
The bidder must confirm that neither the bidder nor its management, supervisory or controlling body members, procurators or other authorised representatives have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, or any other exclusion ground listed in the ESPD. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted.
The bidder must also confirm that it will not use subcontractors or suppliers accounting for more than 10% of the contract value if they are connected to the Russian Federation in the manner described by the sanctions rules. The bidder must further confirm that it will not use subcontractors that are subject to replacement under Section 122(7) of the Public Procurement Act. The bidder must also confirm that the goods offered are not the object of international sanctions and do not originate from sanctioned territories.
Qualification criteria and exclusion grounds
The bidder must be registered in the relevant professional register, and the contracting authority will check this itself through the Register of Economic Activities. The requirement is linked to the activities of construction and electrical works.
The bidder must show a specific annual turnover of at least EUR 220,000 in the area related to the subject matter of the contract during the last three completed financial years. If the 2025 annual report is not yet visible in the e-environment, the information must be entered in the ESPD and its accuracy confirmed.
The bidder must have carried out at least 3 similar general construction works or renovation works as the main contractor during the 60 months preceding the start of the procurement. A list of the main works must be provided, and the contracting authority may request proof that the works were performed properly. If the contracts were awarded through public procurement, the procurement reference number must also be provided.
