Compliance requirements
Mandatory exclusion grounds include situations where the bidder or a person with management, supervisory or representation powers has been convicted of participation in a criminal organisation, corruption, fraud, a terrorist act, money laundering, financing of terrorism, enabling illegal employment, violating the conditions for employing a foreign national, or offences related to illegal child labour or human trafficking. The bidder is also excluded if it has tax, fee or environmental charge arrears, or equivalent arrears under the law of its country of establishment. The contracting authority may also exclude a bidder that has seriously or repeatedly breached an earlier public contract or has submitted false information about qualification or failed to provide requested data or documents. In addition, the bidder’s place of residence or establishment must not be in the Russian Federation or the Republic of Belarus, and materials, equipment and goods used in the works must not be produced in or originate from the Russian Federation or the Republic of Belarus.
Qualification criteria and exclusion grounds
The bidder must have, within the 60 months before the start of the procurement, at least three properly performed contracts for electrical construction works similar to the subject of the contract, including at least one contract worth at least EUR 40,000 excluding VAT. The bidder must provide a list of the contracts showing the performance period, the other contracting parties with the client representative’s contact details, and, in public procurement cases, the reference numbers. The contracting authority may request evidence of proper performance. In addition, the bidder must have an electrical works manager with valid A-competence or at least level 6 qualification under the Vocational Education Institutions Act, with a relevant certificate at the time of bid submission and entered into the EPP environment before bid opening. The bidder must also provide the names, job titles and contact details of the signatory or signatories and the contact person for contract performance; if the right of representation does not arise from the articles of association, a power of attorney must be included. The bid must include a price table in the required form, and all unit price fields must be completed. The bid must comply with all tender documents, and conditional bids or bids with additional conditions are not allowed.
