Compliance requirements
The contracting authority will exclude a bidder if any of the exclusion grounds listed in Section 95(1)(1)–(5) of the Public Procurement Act apply to the bidder or to a member of its management, administrative or supervisory body, a procurator, or another person authorised to represent or control the bidder. These grounds include convictions for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing; convictions for enabling illegal employment of a foreign national or breaching the conditions for employing a foreign national; convictions for illegal use of child labour or human trafficking; tax, fee or environmental charge arrears, or tax or social security contribution arrears in the country of establishment; and any situation where awarding the contract would violate an international sanction or a sanction of the Government of the Republic.
The bidder must confirm that none of these exclusion grounds apply.
Qualification criteria and exclusion grounds
The bidder must be entered in the business register of its country of establishment if this is required by that country’s law. An Estonian bidder does not need to submit a register extract, but a foreign bidder must provide a copy of the document proving registration if required by its national law.
The bidder and/or its subcontractor must have performed at least 1 similar contract during the last 36 months before the start of the procurement, where the subject was maintenance, repair and/or installation work for compressors and/or dryers. Form 2, the list of contracts, must be submitted with the contract name, short description, performance period and the other contracting party. If the bidder relies on a subcontractor’s reference, the subcontractor must also be entered in the subcontractor table so that the contracting authority can check exclusion grounds.
The bidder and/or its subcontractor must have qualified responsible persons for carrying out the works. At least one person managing electrical work is required, with at least a Class B competence certificate or an equivalent or better certificate. Form 3, the list of responsible specialists, and copies of documents proving competence must be submitted. A foreign bidder that does not have the relevant documents issued in Estonia must submit copies of the documents issued under the laws of its country of establishment and a commitment to provide, within one month after signing the contract, the confirmation issued by the Consumer Protection and Technical Regulatory Authority regarding the competence of the responsible person.
