Compliance requirements
The exclusion grounds include at least participation in a criminal organisation, corruption, fraud, and other criminal conviction grounds listed in the ESPD. The bidder or members of its management, representation or supervisory bodies must not have been finally convicted of these offences within the last five years, or the disqualification period stated in the conviction must no longer apply. If an exclusion ground exists, the bidder may submit evidence of self-cleaning measures where permitted. The bidder must also confirm the ability to provide information on payment of taxes and social security contributions.
Qualification criteria and exclusion grounds
The bidder must be the manufacturer or the manufacturer’s authorised sales representative in Estonia and must submit the manufacturer’s confirmation of sales authorisation in Estonia. The bid must comply with the technical specification (Annex 1), and the bidder must provide manufacturer documents and information materials that allow the contracting authority to verify compliance. The bidder’s company must employ at least one service specialist or technician who speaks Estonian and/or English at least at B2 level, has received manufacturer training for servicing and repairing the offered equipment, and whose details together with training certificates or diplomas must be submitted. The bidder must use the forms required by the contracting authority, including the application for participation in the procedure and, where applicable, a power of attorney. If the bidder relies on equivalence, it must explain this and attach evidence of equivalence.
