Compliance requirements

The contracting authority will exclude a bidder if the bidder, or a member of its management, administrative or supervisory body, a procurator or another person authorised to represent or control the bidder, has been convicted of participation in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorist offences or related incitement, aiding or attempt, money laundering or terrorist financing. A bidder will also be excluded if the same persons have been convicted of enabling work for an illegally staying foreign national or of violating the conditions for employing a foreign national in Estonia, including paying less than the statutory wage rate, or of illegal use of child labour or human trafficking. The bidder will be excluded if it has tax, fee or environmental charge arrears under Estonian law, or tax or social security contribution arrears under the law of its country of establishment. The bidder will also be excluded if awarding the contract would breach an international sanction or a Government of the Republic sanction under the International Sanctions Act. The contracting authority may exclude a bidder for serious or persistent breach of a previous public contract, if the breach led to withdrawal from the contract, termination, price reduction, damages or contractual penalty, or if the bidder has provided false information or failed to provide required documents regarding exclusion grounds or compliance with qualification requirements. The machine-readable notice requires a declaration on the absence of exclusion grounds on the specified form, and in a joint tender each joint bidder must submit the declaration for the relevant fields.

Qualification criteria and exclusion grounds

The bidder must be registered in the business register of an EU Member State, an EEA contracting state or a WTO GPA member state, if this follows from the laws of the bidder’s country of establishment. On request, the bidder must provide a valid copy of the registration certificate; a bidder established in Estonia does not need to provide it if the information is publicly available to the contracting authority. If the bidder relies on the capacities of another entity to prove economic and financial standing and/or technical and professional ability, the bidder must state the relied-on entity in the declaration form and also submit that entity’s declaration form. The bidder’s net turnover for each of the last three completed financial years before the start of the procurement (2023, 2024 and 2025) must have been at least EUR 100,000 excluding VAT per year. If the financial year is not 1 January to 31 December, the turnover data must be given for the bidder’s corresponding financial year periods. On request, the bidder must provide an annual report extract or other documents proving the turnover. Within the 36 months before the start of the procurement, the bidder must have completed at least 2 computer sales and/or rental contracts with a total value of at least EUR 100,000 excluding VAT. An ongoing contract is also accepted if it meets these conditions. On request, the bidder must provide the client’s confirmation that the computers were sold and/or rented under that contract without material breaches. The bidder must submit the participation application form, the technical description and specifications for the offered desktop computers, and any equivalence explanations and evidence if equivalence is relied on. The machine-readable notice also requires confirmation of the offer price structure, but the exact price evaluation details are not described here. For the environmental conditions, the bidder must confirm the required warranty, declare REACH candidate substances above 0.1% by mass for the listed components and provide evidence, and describe the reuse and recycling service arrangement, including collection, confidential data handling and dismantling.
