Compliance requirements

The contracting authority will exclude a bidder if any of the following exclusion grounds apply to the bidder or to a member of its management, administrative or supervisory body, a procurator, or another person authorised to represent or control the company: participation in a criminal organisation, breach of integrity duties, corruption, fraud, commission of a terrorist act or related offences, money laundering or terrorist financing; enabling work for a foreign national staying in the country without legal basis or violating the conditions for employing a foreign national in Estonia, including payment of wages below the statutory minimum; illegal use of child labour or human trafficking; tax, fee or environmental charge arrears, or tax or social security contribution arrears in the country of establishment; or breach of an international sanction or a Government of the Republic sanction. The bidder must confirm that none of these exclusion grounds apply to it.

Qualification criteria and exclusion grounds

The bidder must be entered in the business register of its country of establishment if this is required by that country’s law. An Estonian bidder does not need to submit a separate register extract, but a foreign bidder may need to provide proof of registration. The bidder and/or its subcontractor must have qualified responsible persons for carrying out the works. The required specialist is a railway safety equipment mechanic, level 5, or equivalent or better. The bidder must submit copies of documents proving that specialist’s qualifications and competence. If a foreign bidder does not have documents issued under Estonian rules, it must provide equivalent documents from its country of establishment and a confirmation that it will submit, within one month after signing the contract, the confirmation issued by the Consumer Protection and Technical Regulatory Authority regarding the above-mentioned responsible person’s qualifications and competence. The bidder and/or its subcontractor must have performed at least one contract similar to the subject of the procurement, related to the installation of railway safety equipment, within the last 36 months before the start of the procurement, with a total value of at least EUR 10,000. Only the part completed, handed over and accepted during the reference period can be used as proof. The bidder must submit the form “List of contracts” and confirm that the works listed there were carried out in accordance with the concluded contracts and good practice. If the bidder relies on the resources of another company or another joint bidder, it must also provide the details of that entity and, if requested, its consent. Any subcontractor must be added to the subcontractor table so that the contracting authority can check exclusion grounds.
