Compliance requirements
The bidder or candidate is excluded from the procurement procedure if any of the grounds listed in Section 95(1), points 1–5 of the Public Procurement Act apply to the bidder or to a member of its management, supervisory body, procurator or other person authorised to represent it. These grounds include participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, enabling illegal work or violating wage requirements, illegal use of child labour or human trafficking, tax debt, and breach of international or Government sanctions.
The bidder must confirm that none of these exclusion grounds apply to it.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register of its country of establishment, if this is required under that country's law. If registration is required, the bidder must provide an appropriate copy of the document proving the registration. An Estonian bidder does not need to submit a copy of the register document proving registration in the commercial register.
The bidder and/or its subcontractor must have completed at least 1 similar contract within the last 36 months before the start of the procurement, where the subject was maintenance and/or repair services for truck scales. Form 2 – List of contracts must be submitted, including the contract title, short description, performance period and the other contracting party. If the bidder relies on a subcontractor's reference, the subcontractor must also be added to the subcontractors table so that the contracting authority can check the exclusion grounds.
The bidder must confirm that it has the technical capability to carry out the maintenance and repair work, verification and software updates for the scales described in the technical specification. The bid price must be submitted according to Form 1 and all yellow-marked fields must be completed; rows may not be deleted. The bid must comply with the tender documents and conditional bids are not permitted.
