Compliance requirements
The contracting authority will exclude a bidder if any of the exclusion grounds under section 95(1) points 1–5 of the Public Procurement Act apply. These include convictions for organised crime, corruption, fraud, terrorist offences, money laundering or terrorist financing; offences related to illegal employment of foreigners or paying less than the statutory wage; offences related to illegal use of child labour or human trafficking; tax, fee or environmental charge arrears; and situations where awarding the contract would breach an international sanction or a sanction of the Government of the Republic. The bidder must confirm that none of these exclusion grounds apply. If the machine-readable notice does not contain precise requirements, they must be checked in the official tender documents.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register of its country of establishment, if required by that country's law. A bidder established in Estonia does not need to submit a register extract for this. The bidder and/or its subcontractor must have completed at least one similar contract in the last 36 months before the start of the procurement, covering crushing of rock into at least two different fractions (excluding fraction 0–4 mm). The required minimum total contract value is 20,000 euros for Lot 1 (Narva) and 50,000 euros for Lot 2 (Estonia). The bidder must submit a list of the most important similar contracts, including their value, dates and the other contracting parties, using the form 'Lepingute nimekiri'. If the bidder relies on another company’s resources, it must also provide details and consent for that company, and the subcontractor must be entered in the subcontractor table so that exclusion checks can be carried out. For the bid, the bidder must also provide a short description of the crushing and screening equipment used, including theoretical and actual output in tonnes per hour under the relevant material and weather conditions.
