Compliance requirements
The tenderer is excluded if the mandatory exclusion grounds apply: conviction of the tenderer or its management/representation/control persons for participation in a criminal organisation, breach of integrity duties, corruption, fraud, terrorist offences, money laundering or terrorist financing; conviction for enabling illegal employment of a foreign national or violating the conditions of employing a foreign national in Estonia, including paying less than the statutory wage rate; conviction for illegal use of child labour or human trafficking; or tax, duty, environmental charge, social security or similar arrears under the law of the country of establishment. The contracting authority may also exclude a tenderer for serious or persistent breach of an earlier public contract, if the breach led to termination, withdrawal, price reduction, damages or contractual penalty, or if the tenderer has submitted false information about qualification or failed to provide required data or additional documents. Qualification criteria and exclusion grounds
During the 60 months preceding the start of the procurement, the bidder must have properly performed at least three contracts for electrical construction works similar to the subject of the contract, and at least one of them must have had a value of at least EUR 40,000 excluding VAT. A list of the contracts must be submitted, including the performance period, details of the other contracting party, including the client representative’s contact details, and, in the case of public procurement, the reference numbers. The contracting authority may request evidence that the similar electrical construction contracts were properly performed, unless it can obtain the information from public or its own databases without major expense. When submitting the bid, the bidder must also confirm that the bid complies with the tender documents and provide the bid price in the required table. In addition, before bids are opened, the bidder must have in the EPP environment a worker with switching rights, a person responsible for the work operation, and a lead electrical works person with valid A-level competence or, under the Vocational Education Act, at least level 6 qualification, together with the relevant proof. The name, job title and contact details of the contract signatory must be provided, and a power of attorney must be included if authority does not arise from the articles of association.
