Compliance requirements
The contracting authority excludes a bidder if any mandatory exclusion ground applies to the bidder or to its management, supervisory or representative persons: participation in a criminal organisation, breach of integrity duties, corruption, fraud, terrorist offences or related incitement, aiding or attempt, money laundering, or terrorist financing; enabling work for an alien staying in the country without legal basis or violating the conditions for employing an alien in Estonia, including paying less than the statutory wage rate; illegal use of child labour or human trafficking-related offences; or tax, duty, environmental charge, social security contribution or similar arrears under the law of the bidder’s country of establishment.
The contracting authority may also exclude a bidder if it has seriously or repeatedly breached an essential term of a previous public contract so that the contract was terminated, rescinded, the price was reduced, damages were paid or a contractual penalty was paid, or if it has provided false information about meeting qualification requirements or failed to submit the required information or additional documents.
The bidder must confirm that it is not established in the Russian Federation or the Republic of Belarus, and that the materials, equipment and goods used in the works, including components, are not produced in or originating from those countries. The contracting authority may request certificates of origin.
Qualification criteria and exclusion grounds
The bidder must have, within the 60 months before the start of the tender, at least three properly performed contracts for similar electrical construction works, and at least one of them must have a value of at least EUR 40,000 excluding VAT. A list of the contracts must be submitted, including the performance period, the other contracting party’s contact details (including phone and email), and, in public procurement cases, the reference numbers. On request, the bidder must provide evidence that the similar electrical construction contracts were performed properly, unless the contracting authority can obtain the information from public or its own databases without major cost.
The bidder’s team must include a person with valid switching rights for work-related switching in the 0.22–20 kV electricity network, registered in Elektrilevi’s partner portal before the deadline for submitting tenders. If only low-voltage works (0.22–1 kV) are procured, at least low-voltage switching rights are required; in other cases both low-voltage and medium-voltage switching rights are required.
The bidder must also have a person responsible for the work operation, registered in the Elektrilevi partner portal before the tender submission deadline.
The bidder’s team must include a leading electrical works person with valid A-competence and/or a qualification corresponding to at least level 6 under the Occupational Qualifications Act, who has the relevant proof at the time of submission and is entered in the Elektrilevi partner portal before the deadline.
The bidder must submit the price table in the required format and fill in all unit price fields. The offer must fully comply with the tender documents, and conditional offers are not allowed. If the bidder is a joint tenderer, a joint tenderer power of attorney must be attached. The bidder must also provide the names, job titles and contact details of the person signing the contract and the contact person for contract performance matters, and attach a power of attorney if representation rights do not arise from the articles of association.
