Compliance requirements

The contracting authority will exclude a bidder if any of the exclusion grounds under section 95(1)(1)–(5) of the Public Procurement Act apply. In plain language, this covers convictions of the bidder’s management or authorised representatives for organised crime, corruption, fraud, terrorist offences, money laundering or financing terrorism; convictions for enabling illegal employment of foreigners or violating the conditions for employing foreigners in Estonia, including paying less than the statutory wage; convictions for child labour or human trafficking; tax, environmental charge or social security contribution debts; and situations where awarding the contract would breach an international sanction or a Government of the Republic sanction. The bidder must confirm that none of these exclusion grounds apply.

Qualification criteria and exclusion grounds

The bidder must be registered in the business register of its country of establishment, if required by the laws of that country. Proof of registration must be provided, except that an Estonian bidder does not need to submit a register extract. The bidder and/or its subcontractor must have completed at least one similar contract in the 36 months before the start of the procurement, related to supervision services for drilling works for boreholes. A list of the main contracts must be submitted with information on value, dates and the other contracting parties. If the bidder relies on a subcontractor’s reference contract, the subcontractor must be added to the subcontractor table. The bidder and/or its subcontractor must have a valid hydrogeological works licence for drilling boreholes and wells, and a copy of the licence must be submitted. The bidder and/or its subcontractor must also have qualified responsible persons for the works, including a site supervision specialist with at least the professional qualification of Diplomeeritud hüdrotehnikainsener, level 7, or an equivalent or better qualification, or Diplomeeritud ehitusinsener, level 7, specialising in geotechnics with the site supervision competence, or an equivalent or better qualification. Copies of documents proving the qualification and competence must be submitted. For a foreign bidder, if Estonian documents are not available, equivalent documents from the country of establishment must be provided, together with a confirmation that the relevant confirmation from the Consumer Protection and Technical Regulatory Authority will be submitted within one month after signing the contract. The machine-readable notice also requires confirmation that the bid complies with the tender documents and, where relevant, that equivalence has been explained and supporting evidence attached.
