Compliance requirements
The bidder must not have tax debt, environmental charge debt, or social security contribution debt under the laws of its country of establishment, as referred to in the Public Procurement Act. The machine-readable notice did not include any other precise exclusion grounds; these must be checked in the official tender documents.
Qualification criteria and exclusion grounds
The bidder must have at least one properly performed contract from the 60 months before the deadline for publication of the contract notice in the procurement register, under which it carried out port quay construction works or quay repair or reconstruction works. A warranty period may have applied to the contract. The bidder must submit the contract details on the buyer’s form (Annex 3) and a confirmation from the client that the contract was performed properly; an acceptance handover act is not accepted as client confirmation. The bidder must state a short description of the contract, the performance period, the other party’s contact details, and, in a public procurement, the reference number. If the bidder relies on another undertaking’s resources, it must submit the consent form in Annex 5 and the other undertaking must agree to the reliance and participate in direct performance of the contract to the extent relied on. If the bidder relies on a contract performed by another undertaking, that undertaking is treated as a subcontractor and must be added in the procurement register. For joint bidders, the bid must include information on the size and nature of each joint bidder’s share of the contract, using Annex 6 if needed. The person responsible for the quay repair works must have at least Level 6 professional qualification as a civil engineer with specialisation in port construction, in the field of construction management or construction supervision, or an equivalent qualification. If the qualification was obtained outside Estonia, copies of the qualification documents must be submitted. The bidder must also confirm compliance with the tender documents, submit the price in the required structure, and provide the power of attorney if the bid is signed by an authorised person.
