Compliance requirements
The bidder must confirm that none of the mandatory exclusion grounds apply: no convictions for participation in a criminal organisation, breach of integrity, corruption, fraud, terrorist offences or related incitement/assistance/attempt, money laundering or terrorist financing; no convictions for employing a foreign national staying illegally or for violating the conditions of employing a foreign national in Estonia, including paying less than the statutory wage rate; no convictions for illegal use of child labour or human trafficking; and no tax, fee, environmental charge, social security or similar payment arrears. The contracting authority may also exclude a bidder for serious or repeated breach of a previous public contract, or if the bidder has provided false information about qualification or failed to submit required additional documents. The machine-readable notice does not give any other precise exclusion requirements; they must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must have, during the 60 months before the start of the procurement, at least three properly performed contracts for electrical construction works similar to the subject of the contract, and at least one of them must have a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts, including the performance period, the other contracting parties’ details (including the client representative’s contact details such as phone and email), and, in public procurement cases, the reference numbers. On request, the bidder must provide evidence that the similar electrical construction contracts were properly performed, unless the contracting authority can obtain the information from public or its own databases without major cost. In addition, the bidder must have: a person with valid switching rights for 0.22–20 kV electrical network switching tasks, registered in the Elektrilevi partner portal before opening of tenders; a person responsible for work operations with valid rights, also registered in the EPP environment before opening of tenders; a person leading electrical works with valid A-competence and/or at least level 6 qualification under the Occupational Qualifications Act, who has the relevant certificate at the time of tender submission and is entered in the EPP environment before opening of tenders. The bidder must also submit the contract signatory’s details and a contact person for contract performance matters, and if representation does not arise from the articles of association, a power of attorney must be included. The tender must include the price table in the prescribed form, and all unit price fields must be completed. The bidder must accept the standard payment term or indicate participation in the contracting authority’s factoring programme, which changes the payment term to 95 calendar days from receipt of the invoice. The bidder must confirm compliance with all tender documents, confirm that the tender is unconditional, state any business secrets with justification, and confirm that the bidder is not established in Russia or Belarus and that the materials, equipment and goods used in the works, including components, are not produced in or originating from Russia or Belarus. The machine-readable notice does not include any more precise qualification or compliance requirements; they must be checked in the official tender documents.
